A Fairness Hearing was held on January 18, 2008 before the Honorable Ronald M. Whyte in the United States Court House for the Northern District of California, San Jose Division. The Court found the settlement of the claims against Bear Stearns for the sum of $10 million in cash plus interest was fair, reasonable, and adequate to the settlement class; that the Plan of Allocation is fair and equitable; and approved the application of Lead Counsel for the payment of attorney’s fees, reimbursement of expenses, and interest thereon. Class counsel, on behalf of class members, moved for an initial distribution of 55% of the McKesson and AALLP Settlement Funds and the Court took it under submission.
The postmark date for the Bear Stearns litigation was January 11, 2008. The postmark date for exclusion requests was December 4, 2007.
The Court previously held a Fairness Hearing on April 13, 2007 for the settlement of the claims against Arthur Anderson LLP (AALLP) and approved the sum of $72.5 million in cash, plus interest.
On January 27, 2006, the Honorable Ronald M. Whyte held a Fairness Hearing and approved the settlement of the claims against McKesson, HBOC and the individual defendants in the Litigation for the sum of $960 million in cash plus interest.
If you have already submitted a proof of claim form in connection with the McKesson Settlement or the AALLP Settlement, there is no need for you to submit another one.
